Company Fined CNY 5,000 for Including ”**Province Full" in Job Posting”!
At the end of 2023, Company A in Shanghai posted a job advertisement with the note "**Province Full," indicating that the company refused to hire applicants from **Province. This practice imposed restrictions on employment for workers of a specific household registration, infringing on their equal employment rights.
According to the Employment Service and Employment Management Regulations, job postings must not contain discriminatory content or violate national regulations by imposing restrictions on household registration, geographic location, identity, or other conditions that hinder workforce mobility.
For its discriminatory job posting, Company A was ordered by the Shanghai Local Human Resources and Social Security Department to rectify the violation within a specified period, remove the discriminatory content, and pay an administrative fine of CNY 5,000.
Dongjin Advisory:
When posting job advertisements, companies must not illegally set discriminatory conditions based on:
Household registration
Geographic location
Gender
Age
Religion
Marital or parental status
Height
Graduation institution
Medical history
Violations may result in penalties, damage to corporate credibility, and adverse records on public credit platforms, ultimately harming business operations. If unsure about compliance details, seek assistance from experienced professional agencies.
