The State Council agreed that from now until August 1st, 2023, in the Overall Deepening Innovative Development Pilot Areas of Service Trade, to temporarily adjust the implementation of some administrative regulations and documents of the State Council provisions. Specific revisions are stating as follows:
- Regulation on Travel Agencies
Foreign-invested enterprises apply for the business of travel agency, when the application is submitted to the provincial tourism administrative department, the approval time limit will be adjusted from 30 working days to 15 working days from the date of acceptance of the application.
- Regulation on the Administration of Commercial Franchises
(For Hainan Province)
The record of the implementation of franchising activities will be suspended. In the future, the franchisee engaged in commercial franchising activities may not need to file the record of commercial franchising, and due supervision during and after the business operation shall be strengthened.
- Regulation on Patent Agency
The main qualification is no longer limited to Chinese citizens, foreigner who has obtained a permanent residence permit issued by the Chinese government and is qualified as a patent agent in any other country, is allowed to take the Patent Agent Qualification Examination. Those who have passed the examination will be issued the Patent Agent Qualification Certificate by the patent administration department under the State Council.
- Regulations of the People's Republic of China on the Administration of Import and Export of Technologies
Management authority for registration and record of free import and export will be delegated from the Foreign Economic and Trade Department of the State Council to the competent commercial departments at the local and municipal levels.
- Decision of the State Council on Establishing Administrative License for the Administrative Examination and Approval Items Really Necessary To Be Retained
Decision of the State Council to Cancel or Delegate to Lower-level Authorities a Group of Administrative Licensing Items
Circular of the General Office of the State Council Concerning Strengthening the Administration of Holding of Foreign Economic and Technological Exhibitions Within the Territory of China
(For Hainan Province)
Allow foreign institutions independently organize foreign-related economic and technical exhibitions in addition to the name as "China", "national", "country", etc. The administrative license for foreign institutions to independently organize or co-organize the above foreign-related economic and technical exhibitions will be entrusted by the Ministry of Commerce of the State Council to the competent provincial commercial departments to implement and carry out effective supervision.
