The National Development and Reform Commission ("NDRC") and the Ministry of Commerce ("MOFCOM") have recently released the Negative List for Market Access (2019 Edition) (the "List").
The List comprises 131 items, down from 151 in the 2018 version, and Shanghai Dongjin find below main points.
The unified list applies to all market players including both domestic and foreign investors. Industries, fields and businesses not on the list are open for investment to all market players.
The "negative list for industry access (or catalog of prohibited and restricted business) for local national key ecological function areas and key agricultural product production areas" is incorporated into the List.
The List abolished 23 negative lists for market access formulated and published by different regions themselves.
The List will ease market access to a number of sectors, including the establishment of nursing homes and social welfare institutions, to further relax market barriers and boost market vitality.
It also includes newly established access measures such as registration of initial public offerings on the science and technology innovation board.
The authorities will assign uniform codes to items on the List, which provides absolute clarity and paves a way for handling all related matters on the same website.
